Please read these terms of use carefully before using this Mobile App. These terms of use ("Legal Terms") describe the terms and conditions applicable to your access and use of this mobile application (this "Mobile App"), which is operated by and on behalf of the companies comprising the Farmers Insurance Group of Companies® or Farmers® ("Farmers" or the "Farmers companies"). The “Mobile App” shall mean the software provided by Farmers to offer services related to Farmers' services and products to be used on Apple iOS and Android OS devices and any upgrades from time to time and any other software or documentation which enables the use of the Mobile App. 

By installing and using this Mobile App, you are accepting and agreeing to these Legal Terms. If you do not agree to all of these Legal Terms, do not use this Mobile App and uninstall this application. Farmers may modify this Mobile App and the rules and regulations governing its access and use, at any time. Any modification will be included in these Legal Terms, so please check back when you use the Mobile App to see if these terms and conditions have been modified or updated. By continuing use of the Mobile App after such changes are posted, you will be deemed to have accepted such changes.

Scope of Use

Farmers invites you to view, use and download this Mobile App for your personal use, provided that you leave all the copyright notices or other proprietary notices intact. You may not store, modify, reproduce, transmit, distribute, repost, publicly display or otherwise use any content on this Mobile App, or the design or layout of the Mobile App or individual sections of it, in any form or media except with the express prior written permission of Farmers. The commercial use, reproduction, reposting, public display, transmission or distribution of any information, software, logo or other material available through the Mobile App without the prior written consent of Farmers is strictly prohibited. 

You understand that Farmers may, at any time, for any reason and without notice, discontinue, change or restrict your use of this Mobile App and make changes in the products and/or services described in this Mobile App. The Mobile App is currently made available to you free of charge for your personal use. Farmers reserves the right to amend or withdraw the Mobile App, or charge for the Mobile App or service provided to you in accordance with these terms, at any time for any reason. You acknowledge that the terms of agreement with your respective mobile network provider (“Mobile Provider”) will continue to apply when using this Mobile App. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the Mobile App or any such third party charges as may arise from time to time. You accept responsibility for any such charges that arise and agree that Farmers is not responsible or liable for any charges or fees from your Mobile Provider. If you are not the bill payer for the mobile telephone or handheld device being used to access the Mobile App, you will be assumed to have received permission from the bill payer for using this Mobile App. 

You provide consent and all rights necessary to enable offline storage of account and billing information and sync any information on the device with any information that is visible on the Farmers web account.

Eligibility for Insurance Products and Services

Not all of the products or services described on this Mobile App are available in all geographic areas of the United States. You may not be eligible for all of the insurance products or services described in this Mobile App. Farmers reserves the right to determine all eligibility for such products or services in its sole discretion.

The information available on this Mobile App is intended to be a general information resource regarding the matters covered, but is not offered as legal, accounting or other professional advice, and is not tailored to your specific circumstance. You should independently evaluate all information, opinions and advice available on this Mobile App.

No Warranties

This Mobile App, and any products or services or information available through this Mobile App (collectively, "Materials") are provided to you on an "AS IS," "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED.  TO THE FULL EXTENT PERMITTED BY LAW, FARMERS EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, SYSTEMS INTEGRATION, ACCURACY, AND NON-INFRINGEMENT.  

FARMERS DOES NOT ENDORSE NOR MAKE ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS, CURRENCY, OR RELIABILITY OF THE MATERIALS. Farmers makes no representations or warranties that use of the Materials will be uninterrupted or error-free. You are responsible for taking all necessary precautions to ensure that any Materials you may obtain are free of viruses or any other harmful components. This warranty disclaimer may be different in connection with specific products and services offered by Farmers. The information and descriptions contained herein are not necessarily intended to be complete descriptions of all terms, exclusions and conditions applicable to the products and services, but are provided solely for general informational purposes; please refer to the actual policy or the relevant product or services agreement for the governing terms.   

You may have additional rights under certain laws, including consumer laws, which limit the disclaimer of implied warranty or certain damages. Farmers will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by any act or event beyond our reasonable control, including failure of public or private telecommunications networks.  

Limitation of Liability

Your use of this Mobile App and Materials is at your own risk. TO THE FULL EXTENT PERMITTED UNDER APPLICABLE LAW, FARMERS SPECIFICALLY DISCLAIMS ANY LIABILITY, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH ACCESS TO, USE OF OR RELIANCE ON THIS MOBILE APP AND MATERIALS (EVEN IF FARMERS OR A FARMERS REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) OR THAT ARISE IN CONNECTION WITH MISTAKES OR OMISSIONS IN, OR DELAYS IN TRANSMISSION OF, INFORMATION TO OR FROM THE USER, INTERRUPTIONS IN TELECOMMUNICATIONS CONNECTIONS TO THIS MOBILE APP OR VIRUSES THAT MAY INFECT YOUR MOBILE DEVICE, COMPUTER EQUIPMENT OR OTHER PROPERTY, OR ARISE AS A RESULT OF THE MOBILE DEVICE BEING LOST, STOLEN OR MISPLACED BY USER AND ANY OR ALL INFORMATION STORED ON SAID LOST, STOLEN OR MISPLACED MOBILE DEVICE, WHETHER CAUSED IN WHOLE OR IN PART BY NEGLIGENCE, ACTS OF GOD, TELECOMMUNICATIONS FAILURE, THEFT OR DESTRUCTION OF, OR UNAUTHORIZED ACCESS TO THIS MOBILE APP OR THE MATERIALS. This Mobile App and Materials are protected by U.S. and foreign copyright laws. Except as expressly provided under "Scope of Use" section above, you may not use, reproduce, modify, transmit, distribute, publicly display or perform this Mobile App without Farmers' prior written permission.

Visitor Submissions

By providing information, photos or other materials to this Mobile App (other than personal information subject to Farmers Privacy Policy), you grant to Farmers an unrestricted, irrevocable, worldwide, royalty-free license to use, reproduce, display, publicly perform, and transmit such information and materials for any purpose, including without limitation, disclosing any such information and materials as necessary to satisfy any law, regulation, or governmental request. You are prohibited from submitting or transmitting any e-mails or materials through this Mobile App that (A) are racist, supportive of terrorist activities, defamatory, libelous, unlawfully threatening or unlawfully harassing; (B) contain nudity, violence, or offensive subject matter or contains a link to an adult website; (C) solicit personal information from anyone under eighteen (18) years of age; (D) harass or advocate harassment of another person; (E) infringe any third party's copyright, trademark, service mark, trade secret, or other proprietary rights or rights of publicity or privacy; (F) include a photograph of another person that you have posted without that person's consent; (G) promote information, material, or content that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, libelous, obscene, scandalous, inflammatory, pornographic, or profane material, or any other content that could give rise to any civil or criminal liability under the law; (H) involve the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, or "spamming"; or (I) violate any law or regulation (including without limitation those governing consumer protection, unfair competition, anti-discrimination or false advertising). Farmers shall not be subject to any obligations of confidentiality regarding any information or materials that you submit except as specified in Farmers Privacy Policy, as set forth in any additional terms and conditions relating to specific products or services, or as otherwise specifically agreed or required by law.

Prohibited Actions

You cannot: (a) decompile, reverse engineer, disassemble, or modify this Mobile App or Materials or create derivative works based upon this Mobile App or any part thereof; (b) disable any licensing or control features of this Mobile App; (c) introduce into this Mobile App any virus or other code or routine intended to disrupt or damage this Mobile App, or alter, damage or delete any Materials, or retrieve or record information about this Mobile App or its users; (d) merge this Mobile App or Materials with another program or create derivative works based on this Mobile App or Materials; (e) remove, obscure, or alter any notice of the copyright or other proprietary legends on this Mobile App or Materials; (f) sublicense, assign, translate, rent, lease, lend, resell for profit, distribute or otherwise assign or transfer the Materials or access to this Mobile App to others; (g) use, or allow the use of, this Mobile App or the Materials in contravention of any federal, state, local, foreign or other applicable law, or rules or regulations of regulatory or administrative organizations; or (h) otherwise act in a fraudulent, illegal, malicious or negligent manner when using this Mobile App. Except as expressly provided herein, Farmers reserves all rights with respect to this Mobile App, and may pursue all legally available options under both civil and criminal laws (and may cooperate with law enforcement agencies) in the event of any violations.

Third-Party Services

Certain personal and/or commercial services or applications may be offered by third parties through this Mobile App. Farmers is not and will not be responsible for (i) the terms and conditions of any transaction between you and any such third party, (ii) any insufficiency of or problems with any such third party's background, insurance, credit or licensing, (iii) the quality of services performed by any such third party or (iv) any other legal liability arising out of or related to the performance of such services. Because we are not involved in the actual transaction between you and any such third party, in the event you have a dispute with any such third party, you release and hold harmless Farmers and its affiliates, agents, and employees from any and all claims arising out of or in any way connected with such disputes. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE THE CALIFORNIA CIVIL CODE 1542, WHICH SAYS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDIT OR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR."

System Requirements

In order to use this Mobile App, you must have and are responsible for obtaining and maintaining a compatible mobile telephone or handheld device, internet access and the necessary minimum software requirements required by your mobile device. The version of the Mobile App software may be upgraded from time to time to add support for new functions and services.

Farmers offers links to other applications or websites operated by other entities solely as a convenience to you (“Third Party Content”). Farmers makes no representation regarding the content or accuracy of any Third Party Content that you may access through this Mobile App. Farmers does not monitor and is not responsible for the content found on other applications or websites that are linked from this Mobile App. Inclusion of these links on this Mobile App does not imply endorsement, recommendation or sponsorship for any linked Third Party Content or the services, products or advice described on the application or website. The views, opinions, statements, offers or other information or content expressed therein are those of the respective author(s) or distributor(s) and not Farmers. Farmers reserves the right to terminate a link to a third party application or website at any time. The third party sites are not controlled by Farmers, and may have different terms of use and privacy policies, which Farmers encourages you to review. 

If you wish to link to this Mobile App, unless otherwise set forth in a written agreement between you and a Farmers® company, you must adhere to Farmers' linking policy as follows:

(i) any link to this Mobile App must be a text only link,

(ii) the appearance, position and other aspects of the link may not be such as to damage or dilute the goodwill associated with Farmers' names and trademarks,

(iii) the link must "point" to the URL and not to other pages within this Mobile App, 

(iv) the appearance, position and other attributes of the link may not create the false appearance that your organization or entity is sponsored by, affiliated with, or associated with Farmers, 

(v) when selected by a user, the link must display this Mobile App on full-screen and not within a "frame" on the linking Mobile App, and 

(vi) Farmers reserves the right to revoke its consent to the link at any time and in its sole discretion.

Passwords  

You are responsible for maintaining the confidentiality of your username and password. You may not share your password with or transfer your password to any third party. Remember to choose a strong password, including numbers, capital letters, special characters, etc., that is not typically found in a dictionary. The Mobile App will provide an option to check a box, which will allow you to save your username and password. If this option is selected it is the sole responsibility of the user to keep their mobile devices secure by creating and using a passcode to gain access to the mobile device. You acknowledge that Farmers is entitled to act on requests received or instructions provided under your username and password.   

You are responsible for all uses of your username and password, and any and all related charges, whether or not authorized by you. You must immediately notify Farmers of any unauthorized use of your password or username or any other breach of security. Farmers will not be liable for any loss that you may incur as a result of someone else using your password or username, either with or without your knowledge. However, you could be held liable for losses incurred by Farmers or another party due to someone else using your username or password.

Security, GPS and Analytics

Location data provided by any services is for basic navigational purposes only and is not intended to be relied upon in situations where precise location information is needed or where erroneous, inaccurate or incomplete location data may lead to death, personal injury, property, or environmental damage. Use of real time route guidance is at your sole risk. Location data may not be accurate. Neither Farmers, nor any of its content providers, guarantees the availability, accuracy, completeness, reliability, or timeliness of location data displayed by any services. Display of location data for various third-party businesses, including but not limited to vehicle repair shops, towing services, taxi services, and car rental services, does not constitute a recommendation, endorsement, guarantee, or warranty by Farmers of such third-party business.

When you install Mobile App, we may obtain or receive information about your use of our app, your device and usage pattern. We use that information to understand and improve products, services for you and others. This helps us, understand, optimize and deliver services from Farmers. We may also work with our partners to receive information about the websites and apps you're using so we can understand, customize and improve our products and services and those of our partners.

Location Services

Farmers may use Location Services to obtain and process your location. We may use various technologies to obtain your location such as, but not limited to, IP address, GPS, cell towers, Wi-Fi access points and Bluetooth. The accuracy of Location Services can vary depending on your location and the technology used to determine your location. Farmers reserves the right to terminate and not use Location Services without notice. If you choose not to disclose your location, turn off your “Location Services” feature on your mobile device.

Notifications

Farmers may communicate with you electronically in a variety of ways, such as in-app notifications and push notifications on the Farmers Mobile App to send reminders, alerts, informational messages and other Farmers related content (further referred to as 'notifications'). You acknowledge and consent to the receipt of such notifications. You acknowledge and agree that the receipt of notifications is not always guaranteed and that you are responsible for turning this feature on or off. You further acknowledge and agree that the receipt of notifications is dependent on the operation of your mobile phone provider and/or internet service provider. Farmers is not responsible if you do not receive notifications in a timely manner or fail to receive notifications due to a lack of mobile network connectivity or dead zones. You may turn off “Push Notifications” for the Farmers mobile in the settings section.

Farmers may use Bluetooth/Wi-Fi signal to create a more personalized experience while using the Farmers Mobile App. Though the app might not be open on your device this technology may be running in the background. Farmers does not charge a fee, but fees may be imposed by your carrier or service provider depending on your data plan.

Biometrics Scanner

Farmers may offer the option to log into the Farmers Mobile App using Biometrics scanners on compatible mobile devices. In addition, Biometric scanners may be used on some mobile devices as part of the security and authentication process for payment transactions.  If Apple's Touch ID* or Face ID* or Android fingerprint or Face Unlock technology has been enabled on your iOS or Android device, the use of these features to login to Farmers Mobile App or for any other authentication purposes is at your sole discretion and risk.  The feature for login can be restricted by selecting and deselecting certain options on the login page of the Farmers Mobile App. Additionally, the features can be disabled on your device at any time through your device's Settings section. Farmers does not have access to your fingerprint or facial information and does not store any such information.  Please check the most current instructions, terms of use and privacy policy for your particular device. 

IMPORTANT NOTICE: By enabling Apple's Touch ID technology, you allow anyone who has a fingerprint stored on your device to access your account on the Farmers Mobile App. Farmers is not responsible for the individuals who have fingerprints stored on your device accessing your policy, account or any other information available through the Farmers Mobile App. Farmers is not responsible for and makes no representation or warranty whatsoever regarding any such third party Biometric technology including that Farmers is not responsible for the proper functioning of same. Farmers reserves the right to suspend or disable this feature at any time. Touch ID can only be associated with one Farmers login ID at a time on a device.

Violations and Additional Policies

Farmers reserves the right to seek all remedies available at law and in equity for violations of the rules and regulations set forth in this Mobile App, including the right to block access from a particular Internet address to this Mobile App. Our policies regarding privacy are incorporated into these Legal Terms by reference.   

Governing Law, Location and Miscellaneous

These Legal Terms shall be governed in all respects by the laws of the State of California USA, without reference to its choice of law rules. The Mobile App is operated on behalf of the Farmers companies from their offices in Los Angeles, California. Farmers makes no representation that the content of this Mobile App is appropriate or available for use in other locations, and access to this Mobile App from territories where the content of this Mobile App may be illegal is prohibited. Those who choose to access this Mobile App from other locations do so on their own initiative and are responsible for compliance with applicable local laws. These Legal Terms and all documents incorporated herein by reference constitute the entire agreement between Farmers and you with respect to this Mobile App.

Use of This Mobile App By Children

Farmers does not intend to market any products or services to children and does not knowingly collect personal information from children through this Mobile App.  Farmers makes no active effort to collect personal information from children and do1es not wish to receive such information. Farmers requires that Mobile App users must be of legal age to enter into agreements (typically, at least sixteen (18) years of age or older).Disclosures

If you are a California resident, you may have this same information e-mailed to you by sending a letter to the foregoing address with your e-mail address and a request for this information.

Information Storage Authorization

You authorize Farmers to store any information you provide, including, but not limited to, names, addresses, birth dates, driver's license numbers, social security numbers, vehicle identification numbers (VINs), Bank Account or Payment Card information.

You certify that you are the owner or authorized signer for any Bank Account or Payment Card you provide, and you authorize the financial institution where any such Bank Account or Payment Card is held to honor any withdrawals or charges you authorize.

Bank Account Storage Agreement

You agree to receive information via email regarding storage of Bank Account information therefore will maintain a current email address with Farmers and ensure that it is active and capable of receiving new emails. You agree that you will ensure your email account has sufficient space for new emails and your email server and spam-blocking software do not block Farmers emails. You understand Farmers is not responsible for problems arising from emails sent to an inactive or out-of-date email address, unless they are solely negligent for using an incorrect address.

Definitions

“We”, “us” and “our” mean the insurance company(ies) authorized to process One-time or Automatic Bank Payment withdrawals for insurance payments. “You”, “your” and “yours” mean the person or persons authorizing the One-time or Automatic Bank Payment withdrawals for insurance payments. “One-time bank payment” means a single electronic withdrawal being deducted from your designated Bank Account on the date selected by you. “Automatic Bank Payment” means electronic funds transfer (EFT) withdrawals automatically being deducted from your designated Bank Account on the scheduled withdrawal dates for the amounts due. “Business day” means Monday through Friday, excluding our company holidays.

Service Provider

You authorize us to store, or to use a third party to store your Bank Account information.

Returned Payment Charges

We may assess a Returned Payment Charge if One-time bank payments or Automatic Bank Payment withdrawals are returned for reasons such as insufficient funds, closed Bank Account or revoked authorization.

Exclusions of Warranties and Limitation of Liabilities

THE ONE-TIME BANK PAYMENT AND AUTOMATIC BANK PAYMENT PROCESSING SERVICES AND RELATED DOCUMENTATION ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 

In addition, we do not warrant, guarantee or make any representations regarding the security of Bank accounts, or that the web site or Mobile App is free from destructive materials, including but not limited to computer viruses, hackers, or other technical sabotage, nor does it warrant, guarantee or make any representations that access to this site or Mobile app will be fully accessible at all times, uninterrupted, or error-free.

One Time Payment Agreement

“We”, “us” and “our” mean the insurance company(ies) authorized to process One-time bank payment withdrawal(s) or Payment Card charge(s) for insurance payment(s). “You”, “your” and “yours” mean the person or persons authorizing the One-time bank payment withdrawal(s) or Payment Card charge(s) for insurance payments. “One-time bank payment” means a single electronic withdrawal being deducted from your designated Bank Account on the date selected by you. “Payment Card” means any credit or debit card, including reloadable pre-paid cards. “Business day” means Monday through Friday, excluding our company holidays.

Service Provider

You authorize us to use a third party to process the authorized One-time bank payment withdrawal(s) or Payment Card charge(s).

Application of Payments

1. Funds withdrawn or charged will be applied only to the designated billing account(s) or its replacement. 

2. You agree to have the: 

a) Funds available in the designated bank account(s) on the date(s) you request the One-time bank payment(s), whether or not the date(s) falls on a business day. [Note: It may take 3-5 business days for your bank account(s) to reflect the payment(s).]; or 

b) Funds available in the designated Payment Card account(s) on the date(s) you request the charge(s), whether or not the date(s) falls on a business day.

Payments Not Honored

One-time bank payments that are not honored for reasons such as insufficient funds may be resubmitted at our discretion. If we are unable to electronically withdraw the funds from your bank account(s) or charge the payment(s) to your Payment Card(s), any corresponding payment(s) posted in good faith will be reversed from your billing account(s) and cancellation notice(s) may be issued for the policy(ies) attached to the designated billing account(s).

Returned Payment Charges

We may assess Returned Payment Charges if One-time bank payments are returned for reasons such as insufficient funds, closed bank account or revoked authorization.

If you are enrolled at farmers.com, you agree not to allow your user ID and password to be used by any unauthorized individuals. You are responsible for all payments authorized using farmers.com or Farmers mobile app. If you permit other persons to use farmers.com or use your mobile device or your user ID and password, you are responsible for any transactions they authorize. Farmers is not responsible or liable for unauthorized use of your mobile device, your user ID and/or password. If you believe your user ID and password have been lost or stolen or that someone may attempt to use farmers.com without your consent, you must notify us at once by calling (800) 511-0879 during normal business hours of Monday - Friday 7:00 am to 11:00 pm Central Time, Saturday - Sunday 8:00 am to 8:00 pm Central Time.

Maintaining Accurate Information

We are not responsible for any payment processing errors or fees incurred if you do not provide accurate billing account, bank account, Payment Card account or contact information. Billing account and contact information can include, but is not limited to, items such as your name, phone number, address, e-mail address, and bank account or Payment Card account information. To change this information, either update your billing account and/or your bank account or Payment Card account at farmers.com or contact us as indicated below. 

If you need to change information specific to your policy(ies), such as your mailing address, property location or coverages, please visit your Farmers agent.

Payment Authorization

I authorize Farmers Insurance Exchange and/or its affiliates and subsidiaries (“Farmers”) to initiate the one-time payment(s) for the amount(s) indicated above to the bank account(s) and/or Payment Card(s) I am selecting. I understand the withdrawal(s) from my bank account(s) and/or charge(s) to my Payment Card(s) will take place on or after today's date, or on or after the date(s) I am scheduling.

I certify that I am an owner or authorized signer for the selected bank account(s) and/or Payment Card(s). I authorize the corresponding financial institution(s) to honor the withdrawals and/or charge(s).

I authorize any refund due to me to apply to the referenced bank account(s) and/or Payment Card(s); and if necessary, Farmers may electronically debit or credit my bank account(s) and/or Payment Card(s) to correct any transaction(s).

I acknowledge it is my responsibility to have sufficient available funds for the selected bank account(s) and/or Payment Card(s) to cover the payment(s). 

I understand that a scheduled One-time bank payment can be cancelled at least one business day prior to the date my payment(s) is scheduled to occur. Automatic Bank Account Payment Agreement

I understand the Automatic Bank Payment withdrawals will be withdrawn from my bank account on the scheduled withdrawal dates for the amounts due. The withdrawals will begin with the next scheduled payment date. I understand that payments with automatic withdrawal dates on a Saturday, Sunday or holidays may not be processed until the following business day. I also understand and agree that the amounts and dates of the withdrawals are determined by the payment plan I selected for my billing account. 

I authorize any refund due to me to apply to the referenced bank account; and if necessary, Farmers may electronically debit or credit my bank account to correct any transactions. 

I acknowledge it is my responsibility to have sufficient available funds in this bank account to cover these withdrawals.

If a payment is not honored, we may remove your billing account from the Automatic Bank Payment method of payment. If this happens, you will need to re-enroll for the Automatic Bank Payment method by completing and agreeing to a new Payment Authorization with a valid bank account number.

Returned Payment Charges

We may assess Returned Payment Charges if Automatic Bank Payment withdrawals are returned for reasons such as insufficient funds, closed bank account or revoked authorization.

Excessive Returned Payments or Stopped Drafts

If we receive multiple returned Automatic Bank Payment withdrawals, or multiple stopped drafts, your billing account may become ineligible for the Automatic Bank Payment process until a specified date, set at our discretion

Policy Cancellation(s)

If we send a cancellation notice for non-payment of premium for policy(ies) attached to the designated billing account, we will process an Automatic Bank Payment withdrawal for the total payment due including both the amount past due, the current amount due, and any associated fees. The Automatic Bank Payment withdrawal will occur automatically on its regularly scheduled date of the month regardless of any extended due date required by state law. If you wish to change either the date or amount of the automatic withdrawal, or pay only the amount past due, go to http://www.farmers.com/contact-us/, call (800) 511-0879, or visit your Farmers Agent at least 24 hours prior to the automatic withdrawal date. If we receive a request to cancel the policy(ies) attached to the designated billing account, please check the status of the outstanding billing statement at that time. We will discontinue future Automatic Bank Payment withdrawals once we process the request to cancel the policy(ies); however, it is possible that an Automatic Bank Payment withdrawal may be processed about the same time as the policy(ies) cancellation(s).

Billing Statements and Notices

Unless you selected 'Paperless' billing through farmers.com, you understand that by signing up for the Automatic Bank Payment (EFT) process you are agreeing to receive paper billing statements only if: 

· It is the first bill after new business setup or account reinstatement; or 

· The amount differs by $0.01 or more from the last statement for your Farmers billing account. 

You are responsible for reviewing any billing statements and notices mailed to you or otherwise presented to you via www.farmers.com. Billing statements and notices will continue to contain important information about your billing account and the underlying policies.

Billing statements and notices will be made available in PDF or HTML format, so you must have access to an Internet browser and Adobe® Reader® software (this software is available for download free of charge at www.adobe.com via the computer or table). If you wish to print documents, you must also have access to a printer. 

Although there is no charge associated with us presenting your billing statements and notices on-line or through our Mobile App, you may incur costs associated with electronic access to the documents, such as usage charges from Internet access providers and/or telephone service providers. Farmers is not responsible for any damages to your computer hardware or software or mobile device; injury to you as a result of power failures or power spikes, or telephone or internet interruptions or other expenses in relation to your use of electronic delivery. 

Should we make any changes to system requirements for electronic presentation such that you will no longer be capable of accessing or retaining your billing statements and notices electronically via your mobile device, we will inform you of the revised system requirements. 

We are not required to present information electronically and may discontinue electronic presentation in whole or in part at any time. 

You may request a paper copy of any billing statement or notice at no charge by contacting your Farmers agent.

Discontinuing Automatic Recurring Payment Card Charges

The authorization for Automatic Bank Payment withdrawals remains in effect until we have received notice from you of its termination, in such time and manner as to afford us a reasonable opportunity to act upon it. To discontinue automatic withdrawals, go to http://www.farmers.com/contact-us/, call (800) 511-0879or visit your Farmers Agent.

Please allow up to five (5) business days for processing your request. Automatic withdrawals scheduled within five (5) business days after your request may still take place. If you are signed up to have your payments automatically withdrawn electronically and decide to request a cancellation of your policy(ies), please check the status of your outstanding billing statement at that time. We will discontinue future automatic withdrawals once we process your request to cancel your policy(ies); however, it is possible that an automatic withdrawal may have begun to process around the same time as the policy cancellation(s).

Non-waiver

Any failure by us to act upon any breach of these Terms and Conditions shall not be deemed to constitute a waiver of any subsequent breach of that or any other term or condition, or of any right to thereafter enforce these Terms and Conditions.

Automatic Payment Card Agreement

I understand the Automatic Recurring payments will be charged to my Payment Card on the scheduled charge dates for the amounts due. The charges will begin with the next scheduled payment date. I understand that payments with automatic charge dates on a Saturday, Sunday or holiday may not be processed until the following business day. I also understand and agree that the amounts and dates of the charges are determined by the payment plan I selected for my billing account.

I authorize any refund due to me to apply to the referenced Payment Card; and if necessary, Farmers may electronically debit or credit my Payment Card to correct any transactions.

I acknowledge it is my responsibility to have sufficient available funds on this Payment Card to cover these charges.

I agree to receive information via email regarding Automatic Recurring payments therefore I will maintain a current email address with Farmers and ensure that it is active and capable of receiving new emails. I will ensure my email account has sufficient space for new emails and my email server and spam-blocking software do not block Farmers emails. I understand Farmers is not responsible for problems arising from emails sent to an inactive or out-of-date email address, unless they are solely negligent for using an incorrect address.

Definitions

“We”, “us” and “our” mean the insurance company(ies) authorized to make electronic charges for insurance payments. “You”, “your” and “yours” mean the person(s) authorizing the electronic charges for insurance payments. “Automatic Recurring payments” means charges automatically charged to your designated Payment Card on the scheduled charge dates for the amounts due. “Payment Card” means any credit or debit card, including reloadable pre-paid cards. “Business day” means Monday through Friday, excluding our company holidays.

Service Provider

You authorize us to use a third party to make the authorized Payment Card charges.

Application of Payments

1. Funds charged will be applied only to the designated billing account or its replacement. 

2. You agree to have the funds available in the designated Payment Card account on the payment date, whether or not the date falls on a business day.

Payments Not Honored

If we are unable to electronically charge the payment to your Payment Card, any corresponding payment posted in good faith will be reversed from your billing account and a cancellation notice may be issued for the policy(ies) attached to the designated billing account.

Removal from Automatic Recurring Payments

If a payment is not honored, we may remove your billing account from the Automatic Recurring payment method. If this happens, you will need to re-enroll for the Automatic Recurring payment process by completing and agreeing to a new Payment Authorization with a valid Payment Card number.

Excessive Returned Payments or Stopped Charges

If a payment is not honored, we may remove your billing account from the Automatic Recurring payment method. If this happens, you will need to re-enroll for the Automatic Recurring payment process by completing and agreeing to a new Payment Authorization with a valid Payment Card number.

Policy Cancellation(s)

If we send a cancellation notice for non-payment of premium for policy(ies) attached to the designated billing account, we will process a Payment Card charge for the total payment due including both the amount past due, the current amount due, and any associated fees. The Payment Card charge will occur automatically on its regularly scheduled date of the month regardless of any extended due date required by state law. If you wish to change either the date or amount of the automatic charge, or pay only the amount past due, go to go to http://www.farmers.com/contact-us/, call (800) 511-0879, or visit your Farmers Agent at least 24 hours prior to the automatic charge date.

If we receive a request to cancel the policy(ies) attached to the designated billing account, please check the status of the outstanding billing statement at that time. We will discontinue future Automatic Recurring payments once we process the request to cancel the policy(ies); however, it is possible that an Automatic Recurring Payment Card charge may be processed about the same time as the policy(ies) cancellation(s).

Exclusions of Warranties and Limitation of Liabilities

THE AUTOMATIC RECURRING PAYMENT CARD PROCESS AND RELATED DOCUMENTATION IS PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 

In addition, we do not warrant, guarantee or make any representations regarding the security of Payment Card accounts, or that the website or Mobile app is free from destructive materials, including but not limited to viruses, hackers, or other technical sabotage, nor does it warrant, guarantee or make any representations that access to this site or Mobile app will be fully accessible at all times, uninterrupted, or error-free.

IN NO EVENT WILL WE OR OUR AFFILIATES BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, COMPENSATORY, EXEMPLARY OR CONSEQUENTIAL DAMAGES, LOSSES OR EXPENSES, INCLUDING WITHOUT LIMITATION LOST OR MISDIRECTED APPLICATIONS, LOST PROFITS, LOST GOODWILL, OR LOST OR STOLEN PROGRAMS OR OTHER DATA, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY ARISING OUT OF OR IN CONNECTION WITH (1) USE OF THE MOBILE APP OR WEB SITE, OR THE INABILITY TO USE THE MOBILE APP OR WEB SITE BY ANY PARTY; OR (2) ANY FAILURE OR PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION; OR (3) LINE OR SYSTEM FAILURE OR PHONE LINE FAILURE OR INTERRUPTION OR THE INTRODUCTION OF A COMPUTER VIRUS, OR OTHER TECHNICAL SABOTAGE, EVEN IF WE OR OUR AFFILIATES, OR THE EMPLOYEES OR REPRESENTATIVES THEREOF, ARE ADVISED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH DAMAGES, LOSSES OR EXPENSES.

System Requirements/Equipment

We use encryption to make your information unreadable as it passes through the mobile device. Therefore, we strongly recommend that you use the latest version of mobile operating system on your mobile device for maximum security.

Billing Statements and Notices

Unless you selected 'Paperless' billing through farmers.com, you understand that by signing up for the Automatic Recurring payments you are agreeing to receive paper billing statements only if: 

· It is the first bill after new business setup or account reinstatement; or 

· The amount differs by $0.01 or more from the last statement for your Farmers billing account. 

You are responsible for reviewing any billing statements and notices mailed to you or otherwise presented to you via farmers.com. Billing statements and notices will continue to contain important information about your billing account and the underlying policies.

Billing statements and notices will be made available in PDF or HTML format, so you must have access to an Internet browser and Adobe® Reader® software (this software is available for download free of charge at 

Storage of Information

Information stored via the website or Mobile App is kept under physical, electronic or procedural controls that comply with or exceed government and industry standards. We authorize our employees and agents to get information about you only when they need it to do their work for us. We require companies working for us to protect information. They agree to use it only to provide services we ask them to perform for us. Farmers is not responsible for any and all information stored on your mobile device.

Discontinuing Automatic Recurring Payment Card Charges

The authorization for Automatic Recurring Payment Card charges remains in effect until we have received notice from you of its termination, in such time and manner as to afford us a reasonable opportunity to act upon it. To discontinue automatic payment card charges, go to http://www.farmers.com/contact-us/, call (800) 511-0879, or visit your Farmers Agent.

Please allow up to five (5) business days for processing your request. Automatic charges scheduled within five (5) business days after your request may still take place. If you are signed up to have your payments automatically charged electronically and decide to request a cancellation of your policy (ies), please check the status of your outstanding billing statement at that time. We will discontinue future automatic charges once we process your request to cancel your policy (ies); however, it is possible that an automatic charge may have begun to process around the same time as the policy cancellation(s).

Security

If you are enrolled at farmers.com, you agree not to allow your user ID and password to be used by any unauthorized individuals. You are responsible for all payments authorized using farmers.com or Farmers mobile app. If you permit other persons to use farmers.com or use your mobile device or your user ID and password, you are responsible for any transactions they authorize. Farmers is not responsible or liable for unauthorized use of your user ID and/or password. If you believe your user ID and password have been lost or stolen or that someone may attempt to use 

Maintaining Accurate Information

It is your sole responsibility to ensure that your contact and billing account information is current and accurate, as well as your Payment Card account information. We are not responsible for any payment processing errors or fees incurred if you do not provide accurate billing account, Payment Card account or contact information. Billing account and contact information can include, but is not limited to, items such as your name, phone number, address, e-mail address, and Payment Card account information. To change this information, either update your billing account and/or your Payment Card account at farmers.com or contact us as indicated below.

Paperless Policy

Farmers® is pleased to offer electronic delivery of notices and documents applicable to your selected automobile, property, personal umbrella, life, and annuity policies. (Life and Annuity policies are not yet available on the Farmers Mobile App.) Only those policies and accounts that you have selected will be enrolled for this service.

By electing to enroll in electronic delivery (Paperless Policy) you agree to be bound by these Terms of Use in addition to the Terms of Use for www.farmers.com. If you do not agree with any of these Terms of Use, you may not enroll in Paperless Policy.

By enrolling in Paperless Policy and consenting to electronic delivery, you accept and agree to the following:

To receive all available notices and documents applicable to your selected automobile, property, personal umbrella, life and annuity policies, including but not limited to prospectuses, supplements to prospectuses, annual and semi-annual reports, annual statements, privacy statements, quarterly reports, proxy statements, special announcements, declaration pages, endorsements and policy contracts (collectively "documents") via electronic delivery. There may be some documents that we cannot deliver electronically due to legal and/or technological constraints. These documents will be delivered to you via the United States Postal Service (USPS) to your postal address.

Documents will be made available in PDF or HTML format, so you must have a valid email account, access to an Internet browser and Adobe® Reader® software (this software is available for download free of charge at www.adobe.com). For our Farmers Mobile App customers, documents may be available in other file formats compatible for viewing on mobile, tablet, and other devices. You must have relevant software capable of viewing the policy documents on the respective devices. If you wish to print documents, you must also have access to a printer.

As documents become available, we will send you a notification by email which will contain the secure URL where the documents can be viewed, downloaded and printed. For our Farmers Mobile App customers, we may send you notification messages within the Farmers Mobile App. It is your responsibility to log in to view your documents. We will only deliver documents to the policy owner. 

You agree to maintain a valid, current email address and immediately notify us of any change in your email address. You will ensure that your email is active and capable of receiving new emails. To do this, ensure that your email account has sufficient space for new emails and that your email server and spam-blocking software do not block our emails. We are not responsible for problems arising from emails sent to an inactive or out-of-date email address, unless we are solely negligent for using an incorrect address. If an email is returned to us as undeliverable, we will notify you to update your email address through your agent and/or www.farmers.com. We will also resend the email. If it is returned once again as undeliverable we will presume that you have withdrawn your consent, you will be unenrolled in Paperless Policy, and all available policy related documents will be sent to you via the United States Postal Service (USPS) to your postal address. Note that you will always have the ability to access www.farmers.com and view your documents on demand.

You may update your information, such as changing your email address, at any time by logging into farmers.com.

We may continue to send paper copies of certain documents, such as annual statements, if required by federal or state law. Electronic delivery is not currently available for all documents. When documents become available for electronic delivery, we will initiate the electronic delivery process without any further action required by you.

Although there is no charge associated with enrolling in Paperless Policy, you may incur costs associated with electronic access to the documents, such as usage charges from Internet access providers, cellular data providers and/or telephone service providers. Farmers is not responsible for any damages to your computer hardware or software, mobile device(s) or tablet device(s). Farmers is not responsible for any injury to you or damages as a result of power failures or power spikes, or telephone or internet interruptions or other expenses in relation to your use of electronic delivery.

With regard to your selected variable life and annuity policies, you may request a paper copy of any document at no charge by contacting Farmers New World Life Insurance Company ("Farmers Life") Service Center at 1-877-376-8008 or by writing to P.O. Box 724208, Atlanta, Georgia 31139. (Life and Annuity policies are not yet available on the Farmers Mobile App.)

With regard to your selected traditional life and annuity policies, you may request a paper copy of any document at no charge by contacting Farmers Life at 1-206-232-8400. (Life and Annuity policies are not yet available on the Farmers Mobile App.)

With regard to your selected automobile insurance policy, property insurance policy, or personal umbrella policy, you may request a paper copy of any document at no charge by contacting your Farmers Agent.

Your consent to enrollment in Paperless Policy will remain in effect for each selected policy until termination or cancellation of the policy, or until you revoke your consent. Electronic delivery will remain in effect following any policy modification or renewal.

You may revoke your consent at any time by going to www.farmers.com, logging into My Farmers, and selecting Paperless Options under the Documents tab; then click on the View/Choose My Paperless Options tab to unselect the policy(ies) you want to remove from Paperless Policy or, for our Farmers Mobile App customers, by logging in to the Farmers Mobile App and selecting Paperless Options from the left hand navigation menu; then select the policy(ies) you wish to remove from Paperless Policy, and click on ‘Done’. 

You may also revoke your consent by contacting us at 1-877-327-6392 or 1-800-511-0879, or by contacting your Farmers Agent. Upon un-enrolling, all subsequent insurance documents will be mailed to your postal address via USPS. Please allow up to 24 hours to process your un-enrollment. Revocation of your consent shall not affect the legal enforceability of documents provided to you before the effective date of un-enrollment.

If you elect to revoke your consent and no longer choose to receive documents electronically, the Paperless Policy discount on your policy (if any) will be removed.

If, after electing to withdraw your consent to receiving documents electronically, you decide you want to once again enroll in Paperless Policy, you may do so by going to www.farmers.com and completing the enrollment process or going to the Farmers Mobile App and completing the enrollment process. Should we make any changes to hardware or software requirements for Electronic Delivery such that you will no longer be capable of accessing or retaining your documents electronically, we will inform you of the revised hardware and software requirements You will be requested to review the revised Terms of Use and your continued enrollment will serve as your consent to continue participating in the Electronic Delivery option according to the new requirements.

We reserve the right to modify these Paperless Terms of Use at any time. Your continued participation in Paperless will constitute your acceptance of any revisions to these Terms of Use. Please view these Terms of Use on www.farmers.com or the Farmers Mobile App regularly. We are not required to deliver information electronically and may discontinue electronic delivery in whole or in part at any time.

IMPORTANT STATE SPECIFIC DISCLOSURES AND CONSENT LANGUAGE

Specific disclosures and consent language may be required by certain states. Please read the disclosures or consent language below applicable to the state for which your policy is issued.

GEORGIA:

For policyholders of the state of Georgia who have elected to receive all mailings and communications electronically, you hereby agree as follows: I AGREE TO RECEIVE ALL MAILINGS AND COMMUNICATIONS ELECTRONICALLY. SUCH ELECTRONIC MAILING OR COMMUNICATIONS MAY EVEN INCLUDE CANCELLATION OR NON-RENEWAL NOTICES.

TENNESSEE:

The policyholder who elects to allow for selected policy documents, available notices and communications to be sent to the electronic mail address provided by the policyholder should be aware that the election operates as consent by the policyholder for notices to be sent electronically, which may include notice of non-renewal and cancellation. Therefore, the policyholder should be diligent in updating the electronic mail address provided to the insurer in the event that the address should change

Paperless Billing

Farmers® is pleased to offer electronic delivery of notices and documents applicable to your selected automobile, property and personal umbrella accounts. Only those policies and accounts that you have selected will be enrolled for this service.

Farmers™ Paperless Billing refers to our services on farmers.com or the Farmers Mobile App, or both, where you may electronically view bills and billing-related notices and documents. You agree to be bound by these Paperless Billing Terms of Use, in addition to the other Terms of Use for www.farmers.com. If you do not agree with any of these Terms of Use, you may not enroll in Paperless Billing By enrolling in Paperless Billing and consenting to electronic delivery, you accept and agree to the following:

To receive all available billing documents applicable to your selected billing account, including but not limited to statements, notices and correspondence (collectively, "billing documents") via electronic delivery. (Billing documents related to Life and Annuity policies are not yet available on the Farmers Mobile App.) There may be some documents that we cannot deliver electronically due to legal and/or technological constraints. These documents will be delivered to you via United States Postal Service (USPS) to your postal address.

As billing documents become available, we will send you a notification by email containing the secure URL where the materials can be viewed, downloaded and printed. For our Farmers Mobile App customers, we may send you notification messages within the Farmers Mobile App. It is your responsibility to log in to view your bills and billing-related documents. We will only deliver bills and billing-related materials to the billing account holder.

You acknowledge and agree that any named insured on any policy attached to your selected billing account may (A) Access and view all billing documents via My Farmers secure access at www.farmers.com or via the Farmers Mobile App or (B) Enroll or deactivate Paperless Billing options for the selected billing account. You may request a paper copy of a bill or billing-related document at no charge by contacting your Farmers Agent.

You may incur costs associated with electronic access to the billing documents, such as usage charges from Internet access providers, cellular data providers, and/or telephone service providers. Farmers is not responsible for any damages to your computer hardware or software, mobile devices or tablet devices; injury to you as a result of power failures or power spikes, or telephone or internet interruptions or other expenses in relation to your use of electronic delivery.

There is no charge associated with enrolling in Paperless Billing. However, if you elect to revoke your consent for Paperless Billing, any associated service fee discount on your account (if any) will be removed.
